Seminar "Preparing for the Implementation of Personal Data Protection Obligations in Vietnam"

The key points of Decree 13/2023/ND-CP that businesses need to pay attention to; changing and adding personal data processing purposes; deleting personal data; reusing personal data; and technical standards for protecting personal data were the issues discussed at the seminar "Preparing for the Implementation of Personal Data Protection Obligations in Vietnam," organized by the Vietnam Digital Communications Association (VDCA) and the Institute for Policy Studies and Media Development (IPS) on June 29, 2023.

The seminar was attended by representatives from VDCA, IPS, and 110 data driven state-owned enterprises, private enterprises, and foreign enterprises operating in Vietnam, universities, NGOs, consulting companies, and associations both directly and virtually via the Zoom Meetings platform.
Beginning the panel discussion, Mr. Nguyen Quang Dong outlined some key points of Decree No. 13/2023/ND-CP that businesses should take note of, including:
  • Classifying businesses into personal data controllers, personal data processors, and personal data controllers and processors.
  • Conditions for cross-border data transfer.
  • New administrative procedures for businesses.
  • Recommendations for businesses, including checking/ developing/ supplementing the organization's processes, technical data protection measures of the business, and designating the department and personnel responsible for protecting personal data.
  • Some regulations that need ongoing monitoring and guidance, including reusing personal data for business activities and recording and storing logs of personal data processing systems.
In the discussion, businesses gave their opinions and raised questions about the collection of public personal data; changes, supplements to the purposes of processing personal data; deletion of personal data; reuse of personal data; technical standards for protecting personal data; and data collection in public places.
